The following applies to all services General Terms and Conditions for Consulting Services KSE 2013. With regard to the BuildStat software, the following also applies Terms of Use for the BuildStat Software.
The General Terms and Conditions for Consulting Services also apply to dewatering, dewatering installations, environmental monitoring, compaction, and all other work we perform, subject to the specifications and exceptions listed below.
Vertia’s and the Client’s liability for damages is limited to compensation for provable, direct damages and expenses, excluding value-added tax. Neither party is liable for indirect damages.
However, Vertia’s and the Client’s liability shall in no event exceed the amount of Vertia’s VAT-exclusive invoice for the project in question, unless otherwise agreed in writing in advance.
The Client is responsible for ensuring that there is safe access to the necessary premises at the site. The Client is also responsible for ensuring that the site is otherwise sufficiently prepared for the provision of our services.
We reserve the right to use the measurements and results in statistical analysis and development work, while respecting the privacy of our customers and complying with applicable data protection laws.
Any claim for compensation related to the Service must be submitted in writing to Vertia without delay once the Subscriber has discovered the defect or error on which the claim is based, but no later than thirty (30) days from the date the service or related materials were delivered to the Subscriber.
